Obligation to maintain confidentiality and to observe data protection in accordance with the EU GDPR

I was informed today that I am prohibited from using and processing personal data that I become aware of in the course of my work for the German Chemical Society (GDCh), from using it without authorization (without the existence of a legal basis) to process.

I am hereby obliged to observe data protection and to maintain confidentiality. Under the EU-GDPR, violations of data protection regulations according to § 42 DSAnpUG-EU (BDSG-new) as well as other criminal regulations can be punished with imprisonment or a fine. Data protection violations can at the same time mean a violation of labor and service law obligations as well as a violation of the obligations as a functionary in the GDCh and result in corresponding consequences. Data protection violations are also threatened with possibly very high fines for the association, which can lead to compensation claims against you.

I was also informed that there is an obligation of confidentiality for other, non-personal data as well. A breach of data secrecy can also constitute a breach of contractual obligations or special confidentiality obligations for voluntary officials of the GDCh.
